The purpose of this license is to define the conditions under which the Creator provides the Owner intellectual property rights on the Complete Art to which this license is attached (hence the "License"). This license is a non-exclusive, worldwide license. If no other explicit agreement between the Creator and the Owner has been reached, this License shall apply. Unless otherwise specified, the terms of any such agreement supersede any applicable elements of the License.

CREATOR’S OWNERSHIP AND RIGHTS ON THE ART

​

By accepting ownership of the Art, the Owner acknowledges and agrees that it is the sole work of the Creator. All legal rights, including all intellectual property rights, titles, and interests in the underlying Art, belong to the Creator. The Art is acknowledged and agreed to be the sole property of the Creator at all times. The Owner will not receive any rights to the Art as a result of this License.

There are no limitations on the Creator's ability to use or exploit the Art for commercial gain or other non-artistic purposes. This includes but is not limited to: reproduction, adaptation and modification; use; performance; display; publication; distribution; sale; and duplication. It is up to the Creator to decide how and in what media the Art will be distributed and exploited, including but not limited to modifying, editing, modifying, and adding to it, as well as creating and profiting from derivative works based on the Art.

OWNER OWNERSHIP AND RIGHTS ON THE ART

The Creator grants the Owner the following global, exclusive, transferable, and non-sublicensable license on the Complete Art associated with the Purchased NFT, subject to the Owner's continuous compliance with the terms of this License and applicable laws.

The Creator accordingly allows the Owner the right to reproduce, use, exhibit, display, print, duplicate, and exploit derivative works of the Complete Art in any manner and medium it chooses and for any purpose whatsoever, including commercial, to and for the sole personal use of the public.

Exceptionally, only a marketplace that allows the sale of the Owner's Purchased NFT and the related Complete Art will be allowed to display the Complete Art for sale by the Owner, provided that the marketplace cryptographically verifies the rights of each NFT owner to display the Complete Art for its Purchased NFT.

Without the agreement and consent from the Creator, The Owner shall pay the Creator royalty fees equal to 50% of any revenues derived from the commercial exploitation of their NFT's Complete Art in any way, based, if applicable, on the retail price excluding tax.

According to this License, Owners have limited rights in and to the Complete Art. Except as otherwise provided in this License, the Creator retains ownership of the Complete Art.

RESTRICTIONS

 

Without the Creator's express permission, the Owner shall not perform or attempt to do any of the following:

Use the entire work of art in connection with texts, images, videos, or other media depicting hatred, intolerance, violence, cruelty, or anything else that might be considered hate speech, or otherwise violate the rights of others or any applicable law or regulation; violate, in any way, the moral rights of the creator on the entire work of art (including the right of authorship, the right of withholding) and so on.

Third-Party IP (e.g., licensed intellectual property from a celebrity, athlete, or other public figures) is included in the Complete Art associated with the Purchased NFT and the Owner acknowledges and agrees as follows where The Owner shall not have the right to use such Third-Party IP in any way other than as incorporated in the Complete Art, subject to the License and restrictions contained herein; o any commercial rights to exploit or use the Complete Art as a whole are prohibited.

In the event that the License is terminated or expired, this Section will remain in effect.
